Valentine?s Day Lunch:

The Valentine?s Theme lunch included a wonderful array of foods: Vegetable Quiches, ?Savory Finger Foods, Spicy Coconut Rice, Cheese platters, hot & cold Salads, Valentine?s Day Cookies, desserts like Romanian Nalesniki (sweet pancakes) and more.
We reversed the usual order of events to accommodate the program format. We started with the Dance Program followed by a Q & A session. We then broke up for lunch. During the lunch break some of the members joined Mrs. Chantey on the stage to learn the steps of one of the folk dances. We have some very talented members as you can see in the video clips on the Cambodian Dance page. Enjoy!

Valentine?s Day Stories:

During the last 20-30 minutes of the program, two of our members, Marie-Alice and Iko shared their personal stories of how they met their husbands and their experiences being part of a intercultural relationship raising a family.

Marie-Alice spoke of how as a Belgian living in Louisiana, she and her French roommate shared the King?s Day cake and custom with their friends and a neighbor, where the person who is crowned King has to have a Queen. As it turned out the neighbor they had invited won the crown and he eventually asked Marie-Alice to be his Queen for life. They then lived in Iran as ex-pats where, as a young mother, she was struck by a comment made by a local woman who wisely told her that the best way to raise children in two cultures was to pick and choose the best things from each. Finally, Marie-Alice shared her favorite quote on love:??Aimer, ce n?est pas se regarder l?un l?autre, c?est regarder ensemble dans la m?me direction.? Antoine de Saint-Exup?ry
This translates to: ?Love is not to look at each other, rather it is to look together in the same direction?.

Iko talked about her relationship as being ?inter-intelligent?, intercultural and international. She gave us an account of her life growing up in Japan in the 1940?s. Because it was wartime, even though she and her family lived in a safe zone in a valley surrounded by mountains, they used food stamps to get their ration of food. She still has memories of the acute hunger. Over time, she worked for a TV station, then moved to the US and got married.

The Khmer Dance Program:

Kallianne did the introductions and spoke on behalf of her mother, Chantey.

Kallianne gave a brief descrption of Cambodian dance and explained how it intertwined with her mother?s life. Here is the story of Mrs. Chantey as recounted to her daugher:

My name is Chantey. I was born in Phnom Penh. As a young girl, I loved to dance. I started performing since when I was 8 years old at an elementary school in Cambodia. My dance teacher was also a school teacher. She learned to dance from the Royal Palace. She had taught me and my friends a Royal Court dance named Chau Duong.

At the end of every school year, I always competed in the dance category with other schools and won the top prize. I performed for Prince Norodom Sihanouk on a few occasions and for tourists that came to visit Cambodia.

On April 17, 1975, the day the Khmer Rouge took over the capital city, Phnom Penh, my husband and I having only been married for a month, left our beloved homeland. Shortly after that, I was living in Mobile, Alabama and performing at the International Festival ? an event which represents approximately 50 countries every year.

In Massachusetts, I have been working for the Lowell Public School system for 10 years as a bilingual assistant. Nearly every year, I am in charge of teaching traditional folk dances to my students to perform at the school?s Cambodian New Year celebration which happens mid April.

Following the introduction, Kalianne?s Mom performed three very popular Cambodian social dances. They are Ram Vong, Ram Kbach, and Rom Saravan. These dances are performed at special occasions such as Cambodian New Year, wedding, birthdays, and anniversary parties. No one knows if these casual dances have any meaning. One suggested explanation on why most of the social dances are done in circles is that if there are unmarried couples dancing, there is to be no touching.
Mrs. Chantey ended the performance by demonstrating a few parts of the classical dance, Chauv Duong.

ABOUT THE SOCIAL DANCES:

Rom Wong: This is a simplified dance at a fast pace going around the dance floor in a circle.
Rom Kbach: This dance uses the same hand movements as in Rom Wong, but with more complex footwork involving criss-crossing the feet and danced at a slower pace. This is also done in a circle.
Rom Saravan: This dance is not done in a circle. The pairs dance in front of each other with feet going back and forth and the hands are curved and criss-crossed in front of the body at the hip level. The music is fast paced.

FUN FACTS: It is an interesting fact that social dances from around the world have had an impact on Cambodian social culture include the Cuban Cha-cha-cha, the Spanish Bolero, and the Madison ? a sort of electric slide-ish line dance well loved by young, modern adults which came to Cambodia by the French, but was originally from the U.S.-Columbus, Ohio to be exact.

ABOUT THE CLASSICAL DANCE:

Mrs. Chantey completed the performance with a classical Royal Court Ballet dance called Chau Duong.

Background: Royal Court Ballet, as the name suggests, began in the palace. It was originally performed as a form of religious prayer to the deities and ancestors to protect the Khmer kingdom-its people, harvest, and king. You can find evidence of this on the walls of temples in Siem Reap, Cambodia such as Angkor Wat and the Bayon. These temples were built in the 12th century.

Chau Duong: This dance depicts maidens having fun together in a garden. While picking flowers, they build beautiful garlands and wreaths which they adorn themselves. Chau Duong is traditionally performed at important ceremonies, as well as to welcome and entertain guests. The words and gestures of the dance compare the tenderness and beauty of young Khmer women to those of nature and especially to those flowers. You will see in the attached pictorial description the meaning of some of the hand gestures in Khmer classical dance.

This classical dance is famous for its using of hands and feet to express emotion. The dance style revolves highly stylized movement and 4,000 different gestures. These movements are used to tell a story without using any words. It is the abstract style of storytelling that tickles the imagination.

Before every performance, classical dancers pray to the dance master spirits to give them good luck and protection.

FUN FACTS FROM HISTORY:?At the 1906 Colonial Exposition in Marseilles, France, King Sisowath?s royal court dancers were exhibited. Auguste Rodin was captivated by the Cambodian dancers and painted a series of water colors of the dancers. Since then, Khmer classical dance has reached a growing public audience where it now remains a celebrated icon of Khmer culture, often being performed during public events, holidays, and for tourists visiting Cambodia.

NJ Pending Home Sales Tracker: January 29 ? February 4, 2012

In 1 Week the Number of Homes Going Under Contract More Than Doubled From Previous Week

A week where less homes were on the market for sale while simultaneously having more homeowners receive an acceptable offer to purchase makes it a good week indeed. Just what we have been thinking, the market is kicking off early and starting out well. As many in the nation prepared for the big Super Bowl football game, we in real estate also kept an eye on the market to see what Super Bowl numbers would be posted.

We weren?t disappointed. We have not seen 59 residential homes go under contract in one week in months. Just think, the previous week had 25 pending sales.

A home listing is marked under contract (US or UC) in the Garden State Multiple Listing Service (GSMLS) to signify the buyer and seller have completed attorney review and are now in a binding agreement/under contract to continue the process of transferring ownership from the seller to the buyer. It is just as important to know this information as it is to know what has sold. It exemplifies how the market is moving today and what home buyers are looking for now. When you see a home has sold, that home has already been off the market for probably 45 ? 120 days.

The numbers below show how many residential homes went under contract per town along with what percentage of homes in that town went under contract for the week. For example, out of 90 residential homes for sale, if 2 are now under contract that would equal 2.2%. I could also have added the 2 homes under contract to the total number of homes for sale and then divided.

The breakdown of the 59 residential pending home sales follows:

Livingston = 5 (5.5%)
Maplewood = 11 (9.9%)
Millburn/Short Hills = 8 (1.2%)
Montclair = 10 (7.4%)
Nutley = 5 (4.1%)
South Orange = 2 (2.9%)
Verona = 7 (9.6%)
West Orange = 11 (3.8%)

Either way you look at it, Maplewood, New Jersey home sales pending won the week in percentage and amount. Maplewood and West Orange garnered the most amount of homes going under contract for the week, but it was Maplewood NJ homes for sale and Verona NJ homes for sale that showed the biggest dent in inventory. Knowing the percentage of homes available in a specific town that have gone under contract gives a much more accurate pace of the market.

There were 959 (last week 1,050) residential homes on the market across the 8 towns as of February 4.

FMLADA! Sometimes employment laws just look all blurry. Like when you?re required to grant leave to employees under the Family and Medical Leave Act (FMLA) ? and then grant additional time off as a ?reasonable accommodation? under the Americans with Disabilities Act (ADA).

Where does one law stop and the other law start? One court recently answered this question with a bright-line finding. The ADA doesn?t always have to kick in after FMLA leave.

Case in Point: ?Rocky? Brown, a supervisor at a New Mexico supply warehouse, was granted FMLA leave to undergo colon cancer surgery. Later, he was given intermittent FMLA leave to deal with recurring health-related absences. Eventually, Brown exhausted all of his 12 weeks of FMLA leave within a 12-month period. He asked for even more leave, but the company terminated him. Brown sued.

While Brown realized his FMLA leave was ending, he argued that he was denied his rights for a ?reasonable accommodation? under the ADA. Brown claimed the ADA entitled him to either: 1) More unpaid leave; 2) Be able to work from home; 3) Have his duties be assigned to another worker; or 4) Be assigned to another temporary position.

The employer denied he was a ?qualified individual? under the ADA because he could not perform the essential functions of his job?including the physical need to be at work in the warehouse?either with or without a reasonable accommodation.

What happened next?

The court sided with the company, noting two issues. First, while a reasonable accommodation may include working from home, it all depends on the essential elements of the job. Brown was a warehouse supervisor and needed to be in the warehouse to supervise. Second, the evidence, including the doctor?s notes, failed to indicate if and when Brown would ever sufficiently recover from his impairment to return to work. The last doctor?s note stated he ?may? be able to come back to work, but by then Brown had already missed another return-to-work date.

The court ruled, ?Because Brown did not show a reasonable accommodation would allow him to perform the essential functions of his job, we agree?that Brown was not a qualified individual under the ADA and the employer did not wrongfully terminate him.? (Valdez v. McGill, 10th Cir., unpublished opinion 2/13/12).

3 Lessons Learned ? Without Going to Court

1.Be descriptive. Make sure you ?describe? the essential functions of every job in all job descriptions, including the need for physical attendance at work. Pilots and bank tellers are not the only people who cannot work from home.

2. Count accurately. As part of his lawsuit, Brown argued his employer interfered with his FMLA leave. But when the court added up the weeks (to the day), they were all used up. This left Brown no longer protected by the FMLA.

3. Huddle closely. When it comes to untangling FMLA rights from ADA rights, it?s always a best practice for HR professionals and legal counsel to huddle closely. Remember, there was a lawsuit here. But, a huddle before employment actions are taken will prove to be a great return on your investment of time and resources. In this case, the court found there was no case. The employer avoided a very costly trial and possible verdict.

AUGUSTA, Maine (AP) ? Mitt Romney and Ron Paul are the undisputed favorites in Maine, the next state weighing in on the Republican presidential race. They're the only candidates who have made much of an effort here.

The state's Republican Party is set to announce the victor Saturday night of the GOP contest. Local Republican Party committees have spent the last week holding caucuses in schools, town halls and fire stations up and down the state.

The results ? the first step toward electing the state's 24 delegates to the Republican National Convention ? aren't likely to dramatically change the dynamics of the overall GOP race. But the outcome could give bragging rights to the victor as well as an uptick in delegates.

"There are pockets of support for everybody," says state GOP Chairman Charles Webster. Still, he adds: "It's fair to say the race will come down to Romney and Paul."

Romney, the GOP front-runner, is looking to rebound after a trio of losses to former Pennsylvania Sen. Rick Santorum on Tuesday, and is making a last-minute trip to Maine at the end of the week in hopes of avoiding a fourth consecutive loss ? and one all but in the former Massachusetts governor's backyard.

Paul, the libertarian-leaning Texas congressman, is searching for his first victory, visiting the state Friday for a second time in recent weeks. Newt Gingrich is working to reset his campaign after a string of defeats in the weeks since his South Carolina victory, while Santorum wants to capitalize on his burst of momentum.

Both Romney and Paul competed in Maine four years ago and still have some semblance of organizations from those campaigns in the state. Romney came in second place behind John McCain that year, while Paul came in third. Paul was the only candidate to make a pre-caucus visit to Maine. Romney's wife, Ann Romney, held a fundraiser in the state in the fall. Romney's son Tagg also has visited the state, telling Republicans that his father has the business experience and self-discipline to find solutions to tough problems in Washington.

Gingrich and Santorum have had little to no presence and have virtually no campaign organizations in the state.

It's a different political environment than it was back when the presidential spotlight last shown on the state.

In the 2008 general election, Maine voters went heavily for Barack Obama. The state's governor, House and Senate remained in Democratic hands, as had been the case since 2003.

But the tea party emerged in 2010 and made its voice loud and clear by taking over the GOP platform at the state convention, helping propel now-Gov. Paul LePage past six challengers in the GOP primary, and igniting a fire that helped the Republican Party take over both chambers of the Maine Legislature.

For the first time, Sen. Olympia Snowe is facing a primary challenge. Snowe, who's long been known for moderate politics that at times stray from the party line, faces challenges from tea party activist Andrew Ian Dodge and conservative Scott D'Amboise.

Paul's backers have been particularly vocal during the caucuses this year. In Augusta, boisterous Paul supporters greeted party members outside Farrington Elementary School with a Paul-inspired song played to the tune of "New York, New York."

Paul's troops are optimistic and hopeful of a strong finish.

"As in Iowa and New Hampshire, Paul has an active ground game in Maine," said Colby College student Adam Thompson, a Paul supporter. He added: "It will not be won easily."

Romney's campaign boasts a list of prominent state officials backing him, including Attorney General William Schneider, four state senators and seven House members.

"Gov. Romney has had a strategy and organization in the state since early on," said Josh Tardy, a former GOP Maine House leader and Romney supporter. "Romney is hopeful for a good showing in Maine."

What does "free time" mean to you? When you're not at work, do you pass the time -- or spend it?

The difference may impact how happy you are. A new study shows people who put a price on their time are more likely to feel impatient when they're not using it to earn money. And that hurts their ability to derive happiness during leisure activities.

Treating time as money "can actually undermine your well-being," says Sanford DeVoe, one of two researchers at the University of Toronto's Rotman School of Management who carried out the study, which is to be published in the Journal of Experimental Social Psychology.

Prof. DeVoe and PhD student Julian House based their conclusions on three experiments. In each, a sub-group of participants was primed, through survey questions, to think about their time in terms of money. This group subsequently showed greater impatience and lower satisfaction during leisure activities introduced during the experiments. However, those put into the sub-group reported more enjoyment and less impatience when they were paid during one of those activities, which was listening to music.

The experiments' results demonstrate that thinking about time in terms of money "changes the way you actually experience time," says Prof. DeVoe. "Two people may experience the same thing, over the same amount of time, yet react to it very differently."

With growth over the last several decades in jobs paid by the hour, it's important for people to be "mindful," of the impact this can have on their leisure enjoyment, he says, and allow themselves "to really smell the roses."

Almost 87 million, or one in four, Americans will be 65 or older by 2050, according to the Organization for Economic Cooperation and Development.

?The demographic story for health care remains good and will get better,? said Jim Paulsen, who helps oversee about $333 billion as chief investment strategist at Minneapolis-based Wells Capital Management. It still will be hard for investors to pick stocks in the industry, as prospects for hiring and profitability are clouded by lack of clarity on legislation.

The Supreme Court will hear arguments in late March on President Barack Obama?s health-care law, including the requirement that Americans either buy insurance or pay a penalty. Republicans competing for the White House have all said they?ll get rid of the law if they?re elected in November. Regardless of who wins, future presidents may try to turn the clock back on changes made by the previous one, Paulsen said.

?There?s going to be a chronic state of uncertainty in the health-care arena,? making it ?really hard to place specific bets,? Paulsen said. ?There will be opportunities on a value basis, rather than buy-and-hold.?

Aetna, the third-largest U.S. health insurer, and Humana, the second-largest Medicare provider, may offer some of the best rewards for investors, according to Matt Borsch, a health-care analyst at Goldman Sachsin New York.

Competition among health-care providers will limit costs for managed-care companies, many of which also have a low price- to-earnings ratio, he wrote in a Jan. 4 note.

?The labor market is improving very slowly, but at least we?re headed in the right direction,? said David Autor, an economist at the Massachusetts Institute of Technology. Employment in health care ?is definitely going to continue? rising, and manufacturing jobs ?will see a recovery? as demand picks up.

While factories still represent a larger share of the economy ? 12 percent of gross domestic product compared with 7.6 percent for health care ? they have fallen behind since 2008 as a percentage of total payrolls, according to data compiled by Bloomberg News. Health services accounted 11 percent of jobs in 2011, outpacing manufacturing?s 9 percent.

The shift reflects productivity gains as factories produced more goods by replacing workers with technology and by shipping jobs overseas to cut costs. Health services require more face- to-face interaction, which means ?these jobs are protected from the forces of globalization,? Rupkey said. ?We can?t imagine a time when we?ll be able to outsource the job of a home health aide giving a senior a bath or helping with physical therapy.?

Sharon Rudolph, 64, says she?s studying to be a nurse alongside classmates who previously worked in real estate and banking, as well as one who owns a nail salon. While the additional jobs will lift employment, many pay low or very low wages, according to the BLS. That means these workers will have less ability than employees in higher-paid industries to boost consumer spending, the biggest part of the U.S. economy.

?It is fine to have low-skilled jobs as part of the mix or portfolio of employment opportunities,? said Michael Spence, winner of the Nobel Prize in economics in 2001, and a professor at New York University?s Stern School of Business. ?It is better than no jobs. But the mix is important too.?

Charles Roehrig, director of the nonprofit Altarum Institute?s Center for Sustainable Health Spending, said that every 10 jobs in health care ultimately generate an additional 12 elsewhere in the economy. Without the industry?s hiring growth, the unemployment rate would have been 9.5 percent in December, instead of 8.5 percent, he said.

For now, having more jobs ?outweighs any other concern,? he said.

Judge allows 'Sister Wives' suit to proceed

SALT LAKE CITY (AP) ? A federal judge has ruled there's sufficient evidence to allow a polygamous family made famous by a reality TV show to pursue a lawsuit challenging the constitutionality of Utah's bigamy law.

U.S. District Judge Clark Waddoups on Friday dismissed Utah's governor and attorney general from the case, but allowed the suit to proceed against Utah County Attorney Jeffrey Buhman, the Deseret News and Salt Lake Tribune report.

Buhman threatened to prosecute Kody Brown and his four wives ? Meri, Janelle, Christine and Robyn ? after the TLC show "Sister Wives" debuted in September 2010, but his office has not filed charges.

The family sued Buhman, Gov. Gary Herbert and Attorney General Mark Shurtleff in July 2011, claiming Utah's bigamy statute violates its constitutional rights to due process, equal protection, free exercise of religion, free speech and freedom of association.

Waddoups, in his 21-page ruling, wrote that he dismissed Herbert and Shurtleff from the case because Shurtleff assured the Browns that they wouldn't be prosecuted. Shurtleff has a policy of not prosecuting consenting adult polygamists as long as they're not committing other crimes.

But the judge wrote that Buhman conducted interviews with the news media that made it clear he intended to investigate and prosecute the Browns. The fact that no charges have been filed does not matter, he added.

"The entirety of actions by the Utah County prosecutors tend to show either an ill-conceived public-relations campaign to showboat their own authority and/or harass the Browns and the polygamist community at large, or to assure the public that they intended to carry out their public obligations and prosecute violations of the law," Waddoups wrote.

There's reason for the Browns to believe they could face prosecution in Utah County, the judge continued, and that could have a "chilling effect" on their ability to practice their First Amendment rights in the state.

But the Browns must show that there's a real and viable threat to their constitutional rights for the lawsuit to hold up in court, Waddoups wrote.

Brown moved his wives and 16 children from Lehi to the Las Vegas area in January 2001.

Buhman said he had not yet reviewed the ruling and was not prepared to comment.
